Draft for review. Not yet approved for publication.
This Privacy Policy explains how CSEQ Labs, Inc. ("Aixcut," "we," "us," or "our") collects, uses, shares, and protects information when you use our websites, applications, software, APIs, and related tools (collectively, the "Services").
1. Introduction
Aixcut provides AI-assisted video creation, editing, generation, and project workflows. This Policy describes the information we collect, why we use it, when it may be shared, how long it is retained, and the choices available to you.
The Services are operated by CSEQ Labs, Inc., registered at 2810 N Church St, STE 89637, Wilmington, DE 19802, United States. Privacy questions and requests may be sent to [email protected].
2. Scope
This Policy applies when you visit our websites, create an account, use our applications or APIs, upload or generate content, contact support, or otherwise interact with the Services.
It covers information collected by Aixcut or processed on our behalf. Independent third-party websites and services are governed by their own privacy policies. Review those policies and your account settings before using a connected service.
3. Information We Collect
We collect information you provide, information generated when you use the Services, and information received from service providers or connected integrations, depending on the features you use.
- Account and identity information, such as name, email address, profile details, authentication identifiers, and account preferences.
- Project and content information, such as uploaded video, audio, images, documents, scripts, prompts, transcripts, captions, timeline settings, generated assets, and export settings.
- Usage, device, and diagnostic information, such as IP address, browser type, operating system, device identifiers, timestamps, feature interactions, errors, and security logs.
- Billing and transaction information, such as billing details, plan, credit balance, transaction identifiers, invoice status, and limited payment metadata. Stripe processes payments; full payment card details are handled by Stripe rather than stored by Aixcut.
- Support and communications information, including messages, attachments, feedback, and records needed to resolve a request.
4. How We Use Information
We use information to provide, operate, secure, and improve the Services and to meet legal and contractual obligations.
- Create and manage accounts, authenticate users, and maintain project access.
- Process uploaded media, prompts, transcripts, and editing instructions to produce requested outputs.
- Operate editing, generation, transcription, voice, collaboration, export, and support features.
- Detect abuse, fraud, security incidents, service errors, and violations of our terms.
- Measure service performance and develop product improvements, subject to the data-use choices described in this Policy.
- Process payments, credits, invoices, refunds, and related account activity through payment providers.
- Comply with applicable law and respond to lawful requests.
5. Legal Bases for Processing
Where applicable law requires a legal basis, we process information as necessary to perform our agreement with you, comply with legal obligations, pursue legitimate interests such as service security and improvement where your rights do not override those interests, or with your consent. Where consent is required, you may withdraw it at any time.
AI model training is a separate purpose from processing content to complete your requests. Training must have a valid legal basis under applicable law; the content license in our Terms does not replace any consent required by privacy law.
6. AI and Content Processing
Aixcut may send the minimum content required for a requested operation to hosted services and authorized processing providers. This can include media, transcripts, prompts, project structure, tool inputs, and generated outputs.
Content processed to complete an editing, generation, transcription, or export request is used to provide that operation. Any use for training Aixcut models is described separately below.
When you choose to connect a third-party service, it may receive content and other information needed for that connection. Its independent processing is governed by its own privacy policy and your account settings.
7. AI Model Training and Opt-Out
Subject to applicable law, we may use User Content, including uploaded media and text prompts, to train, improve, and develop Aixcut's proprietary AI models and algorithms. This purpose is separate from processing content to provide the Services you request.
You may opt out at any time by emailing [email protected] with the subject "Opt-out of AI Training". Use the email address associated with your account so that we can verify and apply your request. Opting out of training does not prevent us from processing content as needed to provide the Services.
We do not authorize AI providers that process content on our behalf, including OpenAI and Anthropic, to use that content to train their own models. This statement applies to processing arranged by Aixcut; third-party services you use independently are governed by their own policies and settings.
We handle training opt-out requests without undue delay and within the time required by applicable law. We may verify your account before applying the request and will explain its scope, including the treatment of existing content, in our response.
10. International Transfers
Information may be transferred to and processed in the United States by providers such as Google, OpenAI, and Anthropic. Other processing locations depend on the services used. Data-protection laws in those locations may differ from those where you live.
International transfers must comply with applicable data-protection law, including any required lawful transfer mechanism and safeguards. Contact [email protected] for information about the processing locations and safeguards applicable to your use of the Services.
11. Data Retention
We retain information only for as long as needed for the purposes described in this Policy, including service delivery, security, dispute resolution, and legal compliance.
The period depends on the type of information, whether it is needed to maintain your account and projects, resolve a support request or dispute, prevent fraud or security incidents, or meet accounting and other legal obligations. We delete or anonymize information when it is no longer needed for an applicable purpose.
Deletion from active systems may not immediately remove copies from backups. Backup retention is subject to the same necessity and legal-compliance principles; a deletion request does not mean that every backup copy has already been removed.
12. Security
We use administrative, technical, and organizational safeguards designed to protect information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Report suspected security incidents to [email protected]. Privacy-related concerns may also be sent to [email protected].
13. Your Privacy Rights
Depending on your location, you may have rights to access, correct, delete, export, restrict, or object to certain processing, and to withdraw consent. Rights and verification requirements vary by jurisdiction.
To submit a request, contact [email protected]. We may need to verify your identity and authority before completing a request.
We respond without undue delay and within the time required by applicable law. If a request cannot be fulfilled or an extension is permitted, we will explain the reason and any available next steps. You may also have the right to complain to your local data-protection authority.
14. Account and Data Deletion
Request account and associated data deletion by emailing [email protected] from your account email address with the subject "Account and Data Deletion". We may verify your identity before completing the request.
We process deletion requests without undue delay and within the time required by applicable law. Information may be retained where necessary for legal obligations, security, fraud prevention, billing, or the establishment or defense of legal claims. Backup copies are handled under the retention principles described above.
Account deletion and subscription cancellation are separate requests. If you have a paid recurring subscription, request cancellation as well; do not assume that submitting a data-deletion request cancels future payments.
15. Children's Privacy
The Services are not intended for children under 13, and we do not knowingly collect personal information from them. Contact [email protected] if you believe a child under 13 has provided personal information so that we can investigate and take appropriate action.
Users aged 13 or older who have not reached the age of majority where they live must have permission from a parent or legal guardian. Where local law sets a higher age for using the Services or consenting to data processing, that higher requirement applies; parental authorization must be obtained where required.
16. Changes to This Policy
We may update this Policy to reflect changes in the Services, law, or our practices. We will update the date above and provide additional notice when required.
